By accessing or using EverAnswer ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including businesses and individuals who sign up for a free trial or paid subscription.
EverAnswer provides an AI-powered phone receptionist service that answers calls on behalf of your business, collects caller information, and sends you summaries via email. Features vary by subscription plan.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. EverAnswer is not liable for any loss resulting from unauthorized use of your account.
EverAnswer offers a free trial with 25 minutes of call time. No credit card is required to start a trial. Trial minutes are non-transferable and expire when used or when you upgrade to a paid plan. EverAnswer reserves the right to modify or discontinue the free trial at any time.
Paid subscriptions are billed monthly or every six months depending on your selected billing cycle. All payments are processed securely through Stripe. By providing payment information, you authorize EverAnswer to charge your payment method on a recurring basis.
Overage minutes: If you exceed your plan's included minutes, additional minutes will be billed at your plan's overage rate unless you have selected the call forwarding option in your account settings.
Price changes: EverAnswer reserves the right to change subscription prices with 30 days advance notice to your registered email address.
You may cancel your subscription at any time from your billing dashboard. Cancellation takes effect at the end of your current billing period — you will retain access to the Service until then. EverAnswer does not provide refunds for partial billing periods. If you believe you were charged in error, contact us within 30 days at hello@everanswer.io.

EverAnswer reserves the right to suspend or terminate accounts that violate these terms.
EverAnswer records and transcribes calls handled by your AI agent. You are solely responsible for compliance with all applicable call recording laws in your jurisdiction, including federal and state wiretapping laws. Some states require all-party consent to record a call. By using EverAnswer, you agree to obtain any necessary consents and to include appropriate disclosures to your callers.
EverAnswer is not responsible for your failure to comply with applicable recording laws.
EverAnswer's AI agent may make errors, misunderstand callers, or provide incomplete information. EverAnswer is not responsible for any business decisions made based on AI-generated call summaries, transcripts, or other outputs. You should review call logs and verify important information independently.
EverAnswer retains all rights to the Service, including its software, design, and technology. You retain ownership of the content you upload to your Agent Knowledge Base. By uploading content, you grant EverAnswer a limited license to use that content solely to provide the Service to you.
To the maximum extent permitted by law, EverAnswer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost business opportunities, arising from your use of the Service. EverAnswer's total liability to you for any claim arising from these terms shall not exceed the amount you paid to EverAnswer in the three months preceding the claim.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. EverAnswer does not warrant that the Service will be uninterrupted, error-free, or completely secure.
These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of New York.
EverAnswer may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
